LITIGATION

​The Litigation department deals with matters which involve disputes, claims and the recovery of debts, whether through the courts or by means of arbitration.

The department represents a wide variety of corporates, state owned enterprises, and individuals across a broad spectrum of law, such as the fields of insurance, maritime, transportation, insolvency, competition, intellectual property, banking, matrimonial and family, and constitutional.

 

Disputes and disagreements involving:

  • Business, commercial and corporate;
  • Recoveries of non-payment;
  • Insurance claims, insolvencies, liquidations;
  • Matrimonial and family;
  • Trust and deceased estates;
  • Marine, admiralty and maritime;
  • Constitutional and administrative matters;
  • Financing and loan agreements;
  • Property, sectional title, share block;
  • Sales of property, movables and claims;

 

Some examples:

  1. I sold my business and now have a dispute with the buyer about the interpretation of the sale agreement;
  2. My business has been running a loss and I need assistance with sorting out my creditors;
  3. I am in dispute with my family over my share of a family trust;
  4. My insurance company rejected my claim for damage to the roof of my factory building;
  5. I am in dispute with my business partner and we need to dissolve the partnership;
  6. A ship carrying imported cargo has been diverted and there are delays and losses.  Who do I claim from?
  7. My delivery driver caused an accident and I am being sued.
